Welcome to JessicaSimpson.com (the “Site”), a website provided by With You E-Commerce LLC. (“ WYELLC”, “we”, “us” or “our”). WYELLC values your privacy and has created this policy (“Privacy Policy”) to make users of the Site aware of the types of information WYELLC collects in connection with the Site, how that information is used and under what circumstances WYELLC may share that information with others.
COLLECTION OF PERSONAL INFORMATION
When you purchase something from our store, as part of the buying and selling process, we collect personally identifiable information (“Personal Information”) you give us such as your first and last name, address, email address, telephone number, credit card information and the like. If you create an account, you may provide us with additional information such as your gender, birthday, user id, password, other online identifier and the like. When you browse our store, we also automatically collect certain information about you and your device, including information about your web browser, internet protocol (IP) address, time zone and some of the cookies that are installed on your device in order to provide us with information that helps us learn about your browser and operating system. With your permission, we may send you emails about our store, new products and other updates. WYELLC does not collect any sensitive Personal Information.
CONSENT
How do we obtain your consent? When you provide us with Personal Information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your Personal Information for a secondary reason, like marketing, we will either ask you directly for your express consent, or provide you with an opportunity to say no.
How do you withdraw your consent? If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, any time, by contacting us as indicated in “Contact Information” at the end of this Privacy Policy.
SHOPIFY
Our store is hosted on Shopify Inc. (“Shopify”). Shopify provides us with the online e-commerce platform that allows us to sell our products to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. Shopify stores your data on a secure server behind a firewall.
Payment: If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Shopify tokenizes your credit card data, such that WYELLC only has access to the last four digits of your credit card number. Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. THIRD-PARTY SERVICES
In general, the third-party providers utilized by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Personal Information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. Third Party Pixels and Cookies
When you visit our website, log in, register or open an email, cookies, ad beacons, and similar technologies may be used by our online data partners or vendors to associate these activities with information they or others have about you, including your email address. We (or service providers on our behalf) may then send communications and marketing to these email addresses. SECURITY
To protect your Personal Information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
COOKIES
The following is a list of cookies that we use. We’ve listed them here so you can choose if you want to opt-out of cookies: (i) _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc); (ii) _shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits; (iii) _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer; (iv) cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart; (v) _secure_session_id, unique token, sessional; (vi) _storefront_digest, unique token, indefinite, If the shop has a password, this is used to determine if the current visitor has access; and (vii) PREF, persistent for a very short period, set by Google and tracks who visits the store and from where.
OPT OUT POLICY
We recognize how important your online privacy is to you, so we offer the following option for controlling the targeted ads you receive and how we use your data. You can opt out of receiving targeted ads served by us or on our behalf by contacting our Privacy Compliance Officer as indicated in “Contact Information” at the end of this Privacy Policy. Please note that if you delete your cookies or upgrade your browser after having opted out, you will need to opt out again. Further, if you use multiple browsers or devices you will need to execute this opt out on each browser or device. If you opt-out we may collect some data about your online activity for operational purposes (such as fraud prevention) but it will not be used by us for the purpose of targeting ads to you.
AGE OF CONSENT
By using this Site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Site.
TEXT MARKETING AND NOTIFICATIONS
By entering your phone number during checkout and initializing a purchase, subscribing via our subscription form or a keyword, you agree that we may send you text notifications (for your order, including abandoned cart reminders) and text marketing offers. Text marketing messages will not exceed 20 a month. You acknowledge that consent is not a condition for any purchase. If you wish to unsubscribe from receiving text marketing messages and notifications reply with STOP to any mobile message sent from us or use the unsubscribe link we provide you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests will not be accounted as a reasonable means of opting out. PRIVACY RIGHTS
I. Specific Rights Under EEA, UK and Canada Law
In some regions like the European Economic Area (EEA), United Kingdom (UK) and Canada, you have certain rights under applicable data protection laws. These may include the right to: (i) request access and obtain a copy of your Personal Information; (ii) to request rectification or erasure; (iii) to restrict the processing of your Personal Information; and (iv) if applicable, to data portability. You may review, change or terminate your account at any time. Upon request to terminate your account, we will deactivate or delete your account and Personal Information from our active databases. We may, however, retain some information in our files to prevent fraud, troubleshoot problems, assist with investigations, enforce our legal Terms and/or comply with applicable legal requirements.

II. Specific Rights Under California Law
California Civil Code Section 1798.83 permits users that are California residents to request and obtain from us, once a year and free of charge, information about categories of Personal Information (if any) that we disclose to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared Personal Information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please contact our Privacy Compliance Officer (see “Contact Information” at the end of this Privacy Policy).
If you are under 18 years of age, reside in California and have a registered account, you have the right to request removal of unwanted data that you publicly post. To request removal of such data, please contact us (see “Contact Information” at the end of this Privacy Policy) and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed, but please be aware that the data may not be completely removed from all of our systems (e.g., backups, etc.).
III. California Consumer Privacy Act (CCPA) Notice
The California Code of Regulations defines a “resident” as: (i) every individual who is in the State of California for other than a temporary or transitory purpose; and (ii) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose. (6) Geolocation data (for example, device location); and
(7) Inferences drawn from other Personal Information (for example, inferences drawn from collected Personal Information referenced above to create a profile or summary about an individual’s preferences).
We may also collect other Personal Information outside of these categories where you interact with us in the context of: (i) receiving help through customer support channels; (ii) participation in customer surveys or contests; (iii) responding to your inquiries; and/or (iv) facilitating the delivery of our products to you.
Note: WYELLC does not store credit card information. Shopify does store credit card information, but it is tokenized, such that WYELLC only has access to the last four digits of the credit card number.
B. Sharing and Use of Personal Information
We may share your Personal Information with third-party vendors, service providers, contractors or agents (“Third-Party Providers”) who perform services on our behalf and require access to such Personal Information to do that work. Each Third-Party Provider is a for-profit entity that processes the information on our behalf. The categories of third parties we may share Personal Information with include data analytics services and ad networks. We may also share your Personal Information: (i) in connection with business transfers (e.g., during the sale of company assets); (ii) to our affiliates (which will be bound by this Privacy Policy); and (iii) to our business partners to offer you certain products, services or promotions. We may disclose your Personal Information if we are required to do so by law or if you violate this Site’s Terms & Conditions.
We may also use your Personal Information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be “selling” of your Personal Information. We have not sold any Personal Information to third parties for a business or commercial purpose in the preceding twelve (12) months.

C. Your Rights Regarding Personal Information
(1) Request for Deletion
You can ask that your Personal Information be deleted. If you ask us to delete your Personal Information, we will respect your request and use reasonable efforts to delete your Personal Information, subject to certain expectations provided by law, including but not limited to, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.
(2) Request for Information
Depending on the circumstances, you have a right to know: (i) whether we collect and use your Personal Information; (ii) the categories of Personal Information that we collect; (iii) the purposes for which your Personal Information is used; (iv) whether we sell your Personal Information to third parties; (v) the categories of Personal Information that we sold or disclosed for a business purpose; (vi) the categories of third parties to whom the Personal Information was sold or disclosed for a business purpose; and (vii) the business or commercial purpose for collecting or selling Personal Information.
(3) Other Privacy Rights
You may: (i) object to the processing of your Personal Information; (ii) request correction of your Personal Information if it is incorrect or no longer relevant; (iii) ask to restrict the processing of Personal Information; (iv) designate an authorized agent to make a request under this Privacy Policy on your behalf (we may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with CCPA); and (v) request to opt out from future selling of your Personal Information to third parties.
(4) No Discrimination
We will not discriminate against you if you exercise your privacy rights.
(5) Processing Your Request
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. We will only use the Personal Information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purpose of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security and/or fraud prevention purposes. We will delete such additionally provided information as soon as we finish verifying your identity.

CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the Site. If we make material changes to this Privacy Policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
